1. Introduction to Terms and Conditions

1.1 Welcome to the Exodus Experience!

1.2 The Exodus Experience is an invitation to a wholistic Faith-based journey of personal renewal and growth. It is not a program but a full-immersive journey undertaken together with likeminded persons (“The Exodus Experience” or “the Journey”)).

1.3 The Journey is presented by The Exodus Experience (Pty) Limited, registration number 2025/938501/07 (“the Company,” “we” or “us”), and by subscribing to The Exodus Experience, through the Website sign-on, you hereby agree to the terms and conditions set out herein (“the T&Cs”). You also confirm that you are an adult, being 18 years or older, and have read and understood these T&Cs.

1.4 The Exodus Experience makes use of computer and mobile platforms (e.g. the Website, emails, Whatasapp, Facebook and Instagram) to deliver content, provide support and encourage interaction. These T&Cs apply to The Exodus Experience as provided on each and every site, platform or forum that is used (“the Exodus Experience Platforms”).

1.5 What is The Exodus Experience?

The Exodus Experience is:

- A Multidimensional journey of personal transformation that integrates body, soul and spirit;
- Supported by powerful testimonies of real-life breakthrough related to healing, weight loss, emotional restoration and renewed identity in Christ;
- Based on biblical teachings anchoring the entire journey in the Bible and God’s original design for human wholeness;
- Practical advice and lifestyle guidance to help women detox, reset, restore and rebuild their physical, psychological and spiritual health;
- Supported by personal coaching, mentorship, support and encouragement along the journey;
- a journey that involves reflection, truth-telling, forgiveness and freedom from old destructive habits, attitudes and thought-patterns;
- a tool for lifestyle reformation through the restructuring of daily rhythms around work and rest, sleep, nutrition, hydration and movement;
- an invitation not to rely on willpower, but on the grace, the presence and the power of God;
- a 40 day walk with God, learning to hear his voice, to break with old patterns and behaviors and to step into a newness of life;
- a journey of working together with others, encouraging one another, praying for one another and celebrating victories big and small.

The Exodus Experience is an explicitly Christian Journey. This does not per se exclude non-Christians from participating. However, no attempt will be made to justify Christian biblical principles and there will be no discussion or defence of the tenants of the Christian faith. Any attempt to question the Christian Faith may result in the termination of your participation in the Journey.

1.6 What The Exodus Experience is not!

The Exodus Experience is not a new fad diet. Neither is it medical advice or therapy. It is a self-directed journey of personal transformation and renewal, facilitated through interaction with fellow-Christians who are on or have been on a similar journey. It is based on the personal experiences of others, and is undertaken at your own risk.

The Exodus Experience is dependent on your participation and your stewardship of your time and resources. There is no guarantee of results, beyond those you achieve during the Journey.

2. Participant Obligations

2.1 Your participation is entirely voluntary and you may terminate your participation at any time by giving notice in writing. However, all payments made by you are non-refundable.

2.2 Whilst on the journey you are expected to participate in the discussions and on the platforms provided. This is for your own benefit and for the benefit of the others on the journey with you. The quality of everyone’s experience is tied to the participation of the members of the group.

2.3 You will take full responsibility for your health and safety during the journey. You have been advised to consult with your doctor prior to undertaking the Journey. If you have any concerns about your physical health and safety you must consult with your doctor or a healthcare practitioner. In particular, if you have any eating disorders, a chronic medical condition, are pregnant or breast feeding, you agree to take medical advice.

2.4 As a participant on the Journey, you are obliged to conduct yourself in a diligent, respectful and conscientious manner at all times and shall not act in a manner which can be ascribed to and/or jeopardise the reputation of the Company, The Exodus Experience or a fellow participant on The Exodus Experience.

2.5 As a participant on the Journey you are obliged at all times to be truthful and you undertake that all your interactions will be honest, transparent and respectful. In addition, you undertake (in your own interests and those of The Exodus Experience and other participants) to diligently follow the program and processes laid out. This includes active participation on the Whatsapp Group (or similar prescribed platform)

2.6 As a participant on the Journey you are obliged at all times to respect the confidentiality of information shared by fellow participants on the Exodus Experience Platform. You will not copy or direct any materials or contributions received by you on the Exodus Experience platform to non-participants nor to external platforms. Furthermore, you warrant that you will treat all Personal Information in accordance with the Exodus Experience Data Protection and Privacy Laws [insert Link].

2.7 As a participant on the Journey you will not directly or indirectly use any of the Personal Data you find on the Exodus Experience Platforms for any other purpose than participating on the Journey. You will not use any Personal Information for any other purpose, including, but not limited to marketing or on-selling.

3. Payment terms

3.1 You subscribe to The Exodus Experience by signing on and making payment on the Website. All fees are non-refundable.

3.2 If your participation on the Journey is terminated by the Company for breach of this Agreement, you will forfeit your subscription fee, which is agreed to be a fair and reasonable pre-estimation of damages.

3.3 The subscription fees do not include the purchase of suggested or recommended products, which you may purchase separately if you so wish.

3.4 You are of course responsible for the costs of your connectivity and participation on the various platforms, which will include data charges payable to your service provider.

3.5 The current charges are exclusive of VAT, which may be charged in addition as and when we are registered for VAT.

4. Ownership and Intellectual Property

4.1 You acknowledge and that all rights, title and interest in and to the programme known as The Exodus Experience, including without limitation all curriculum, written materials, presentations, tools, techniques, methodologies, frameworks, assessments, audio-visual content, branding, trade names, logos, training manuals, digital resources and any other associated works (“Journey IP”), whether existing or developed thereafter, are and shall remain the exclusive property of the Company.

4.2 Nothing in this Agreement, nor on any Exodus Experience Platform shall operate to transfer, assign or otherwise convey any Intellectual Property Rights in the Journey IP to you.

4.3 You are granted a non-exclusive, non-transferable, non-sub-licensable and revocable licence to use the Journey IP solely for personal participation in the Journey and strictly in accordance with the terms of this Agreement.

4.4 You have no right to modify, adapt, translate, copy, distribute, commercialise, publish, teach, display, or create derivative works from the Journey IP whatsoever.

4.5 You acknowledge that the Journey IP contains confidential, proprietary and commercially valuable information to the Company as the owner thereof. Therefor you agree to maintain the confidentiality of the Journey IP and to take all reasonable steps to prevent unauthorised use, reproduction, disclosure, dissemination or exploitation thereof. Unlawful disclosure will be harmful to the Company.

4.6 You shall not, directly or indirectly, create, offer, facilitate, market or deliver any programme, service, workshop or content that is derived from, materially similar to, adapted from, or otherwise based on the Journey IP.

4.7 Any improvements, adaptations, refinements or derivative works to the Journey IP created by you, or with your inputs, during or as a result of participation in or exposure to the Exodus Experience (“Improvements”) shall vest automatically in us immediately upon creation. You hereby irrevocably assign to the Company all rights, title and interest in and to such Improvements, and agree to sign all documents reasonably required to perfect such assignment.

4.8 Any unauthorised use, reproduction, dissemination or exploitation of the Journey IP constitutes a material breach of this Agreement and the Company shall be entitled, without limitation, to seek urgent interim relief, damages, specific performance and any other remedies available in law or equity.

5 Privacy and Confidentiality

5.1 For purposes of this clause, “Confidential Information” includes, without limitation:

(a) all course content, materials, resources, teachings, tools, methodologies, programme structures, exercises, assessments and any related documents or digital content provided as part The Exodus Experience (“Journey Materials”); and

(b) all personal disclosures, reflections, testimonies, discussions, experiences, insights, contributions, questions, statements, or other information shared by any participant or facilitator during the Journey or on the Exodus Experience Platform, whether verbally, in writing, in group sessions, or via digital platforms (“Participant Contributions”). And Confidential Information expressly includes any information identified as confidential or which, by its nature or context, is reasonably understood to be confidential.

5.2 You hereby undertake to keep all Confidential Information strictly confidential and not to disclose, reproduce, record, copy, publish, disseminate, share, distribute, or use such information for any purpose other than personal participation in the Journey. This obligation extends to all Programme Materials and all Participant Contributions, irrespective of the format or medium in which they are shared.

5.3 You hereby acknowledge the importance of creating a safe and respectful environment for personal sharing. You may not share, disclose or repeat any Participant Contribution outside the Journey—even anonymously—without the express prior written consent of the Company and the participant concerned.

6 Third Party, services links and referrals

6.1 The Exodus Experience is made available, and the Exodus Experience Platform is provided on an “as-is” basis. We do not guarantee the outcome of the use of thereof and you hereby waive any and all claims against us in relation thereto.

6.2 The Exodus Experience is reliant on third party services, such as Whatsapp. We are not liable for any act or omission of any third party service provider or platform.

6.3 Wherever you are referred to a third-party service provider or products, we do not warrant the efficacy, suitability, security, sustainability, performance, service provision or otherwise of the third-party. Furthermore, we are not liable for the services or products provided to you by third parties, even though the third-party is linked to The Exodus Experience Platform or may be endorsed by The Exodus Experience or any of the presenters, participants or providers of testimonials in respect thereof.

6.4 Exodus Experience shall under no circumstances be liable in respect of any services or products provided by third parties, even if these are procured through the platform, and you hereby waive any such claims and indemnify and hold us harmless in respect of any claim arising from the use of any third party products or value added services.

6.5 The Exodus Experience is delivered in association with Lechi Kamffer and Hadassah Healing Oils (Pty) Limited. Lechi’s experience related to body, mind and spiritual wellness, detoxification and the reset of body, mind and emotions play an important role in the presentation of the Journey. However, Hadassah Healing Oils is a separate legal entity and any and all transactions between you and Hadassah Oils are independent of The Exodus Experience and are subject to separate terms and conditions, as set out at www.hadassahhealingoils.com.

7. Terms and conditions relating to access to and use of the Exodus Experience Platform

7.1 You may not use the Exodus Experience Platform for any illegal or unauthorized purpose and you shall comply with all legislation, rules, notices, policies, directives, industry codes, and regulations applicable to your access and use of the Platform.

7.2 You may not use the Exodus Experience Platform for spam or for direct marketing.

7.3 You may not access the Exodus Experience Platform by any other means than those officially permitted by us. You must not hack or attempt to hack or assist any other person to hack into the platform, or otherwise gain unlawful access to the platform and its data.

7.4 You may not interfere or disrupt the Exodus Experience Platform, or any third party services or networks linked thereto, including by transmitting any malware, spyware, viruses, worms or introducing destructive or malicious code or by creating accounts on the platform through unauthorized means, including, but not limited to, by automated device, script, bot, spider, crawler or scraper.

7.5 You are responsible for any activity that occurs through your account. You may not allow any other person to access your account.

7.6 Should you not comply with any of your obligations in terms of this clause 7, we have the right to suspend your account with immediate effect and without notice.

7.7 You hereby agree that you are familiar with and accept the terms of The Exodus Experience Data Protection and Privacy Policy.

7.8 You hereby indemnify and hold us harmless in respect of any claim howsoever arising from your breach of any of the undertakings in this clause 7.

8. Limitation of Liability

8.1 In no event will the Company, or any of its directors, staff or contractors be liable to you in contract and/ or delict (including negligence), for any indirect, exemplary, special, punitive, incidental or consequential losses or damages of any kind whatsoever and howsoever caused, even if foreseeable or if we were advised of the possibility of such damages arising under or in connection your participation in the Journey, or access or use of the Exodus Experience Platform.

8.2 Furthermore, under no circumstances shall the aggregate liability for damages exceed the fees paid by you In respect of The Exodus Experience, and you hereby waive any claims in excess thereof.

8.3 You hereby irrevocably waive any and all claims against any and all of the Company’s directors, staff, contractors or the presenters of The Exodus Experience, any and all persons sharing their testimonies and experiences related there to, in particular (but without limitation) Lechi Kamffer and Aletté Winckler.

9. Indemnity

You hereby indemnify us against any and all claims, costs, damages and/or loss that it may sustain or incur, as a result of any claim by a third party, including other participants in the Exodus Experience, arising from: (a) your acts or omissions including, but not limited to, your participation on the Exodus Experience Platform; and (b) your breach of the terms and conditions of this Agreement.

10. Breach

Should any Party commit a breach of this Agreement, the aggrieved Party shall be entitled to give the defaulting Party notice in writing calling upon the defaulting Party to remedy the breach. Should the defaulting Party fail to comply with such notice within 3 (three) Business Days of receipt of such notice, then, without prejudice to any other rights the aggrieved Party may have in law, the aggrieved Party shall be entitled to enforce performance in terms of this Agreement, without prejudice to any right the aggrieved Party may have to claim damages from the defaulting Party.

11. Arbitration

11.1 Should any dispute, disagreement or claim arise between the parties (called hereafter “the dispute”) concerning this agreement, then either Party may submit the dispute for final and binding resolution in accordance with the Rules of the Arbitration Foundation of Southern Africa (“the Foundation”) by a single arbitrator as agreed to by the parties, or failing which is appointed by the Foundation; provided that nothing in this clause shall prohibit a Party from approaching a court of competent jurisdiction for an order for urgent and/or interim relief pending the outcome of the arbitration.

11.2 The Arbitration shall be held in front of one Arbitrator with the hearing being held in English and in Cape Town, South Africa (unless otherwise agreed in writing).

12. Governing Law

This Agreement is governed in all respects by the laws of the Republic of South Africa, but excluding the provisions relating to conflicts of law to the extent that these may provide that this Agreement falls to be governed by any other laws.

13. Domicilium and Notices

13.1 We may give any notice required by the Agreement by means of a notice to you on any of the Exodus Experience Platforms, electronic mail to your email address on record with us, or electronically via your cell phone number on record with us.
Such notice shall be deemed to have been given once the notice was posted, or the email or text message sent.

14. General provisions

14.1 This Agreement and your rights and obligations under the Agreement may not be assigned, delegated, or otherwise transferred, in whole or in part by you without our express prior written consent. Any attempted Instruction, delegation, or transfer in breach of the foregoing will be null and void.

14.2 Our failure to insist upon or enforce strict performance of any provision of the terms and conditions agreed upon will not be construed as a waiver of any provision or right. No waiver of any of these terms and conditions will be deemed a further or continuing waiver of such term or condition or any other term or condition.

14.3 The Agreement is the final, complete, and exclusive agreement of the parties with respect to the subject matter hereof and supersedes and substitutes all prior or contemporaneous communications and understandings between the parties.

WITHOUT LIMITNG THE GENERALITY OF THE PROVISIONS OF THIS AGREEMENT THE FOLLOWING DISCLAIMERS ARE MADE:

1. Ketosis Disclaimer:

You acknowledge that although this is not a ketogenic programme (high fat, high protein), your body may naturally enter ketosis during detox and metabolic reset. Your body will consume the necessary amounts of protein needed.

2. Detox Reaction Disclaimer

You acknowledge that detox symptoms may include fatigue, headaches, irritability, digestive changes, emotional responses, changes in cycles, cravings, body aches, or skin breakouts. You acknowledge that various recommendations will be made to you in respect of managing the symptoms of detoxification, which you will undertake to consider in consultation with your doctor if necessary.

3. Post-Detox Stabilisation Disclaimer

You understand that the 30-Day Metabolic Stabilisation Phase is required for long-term success and weight maintenance. You acknowledge that skipping or altering this phase increases the risk of weight rebound and that we cannot be held liable for weight regain.
